Affiliate Program Terms

These Affiliate Program Terms ("Affiliate Terms") apply between SOS Web Design LLC, doing business as Jewelry Website Designers ("we", "us"), and each person or business accepted into the AI Build affiliate program ("Affiliate", "you"). By applying, you accept these Affiliate Terms. Sections 16 to 21 of our Terms of Service (disclaimers, liability, indemnity, disputes, changes and general terms) also apply.

1. Joining the program

You must be at least 18 and give true information in your application. We review every application and may accept or refuse it at our discretion.
You act as an independent contractor. You are not our employee, agent or partner and may not make promises, sign contracts or accept payments on our behalf.

2. Referrals

Once accepted, you receive a personal referral link and a referral code. A business is credited to you when it creates an AI Build account through your link within 30 days after clicking it, or when it enters your referral code while creating the account. If it used links or codes of several affiliates, the code entered at sign-up counts, otherwise the last link clicked before sign-up.
The referral is remembered with a cookie only when the visitor allows marketing cookies; otherwise only for that visit. We are not responsible for referrals that are not tracked because of a visitor's cookie choices or browser settings.
Not eligible: your own accounts or those of your business, existing or former customers, and accounts created by fraud, incentives we did not approve, or in breach of these Affiliate Terms.

3. Commission

You earn the commission percentage shown when you are accepted (currently 25%) of each payment we actually receive from a business you referred for its subscription plan, monthly or yearly, for as long as it stays a customer and you remain in the program in good standing.
Only the plan counts. Add-ons, prepaid packs (for example extra minutes, conversations or SMS credit) and custom work (integrations, custom agents, set-up fees) do not earn commission.
Commission is calculated on the plan amount actually paid, after any discount and excluding taxes. When the business changes its plan, the commission follows the plan it pays for: higher after an upgrade, lower after a downgrade. A yearly plan earns its commission when the yearly payment is received.
The rate that applies is the one in force when the business pays. Commission is not earned on refunded, disputed or charged-back amounts; commission already paid on such amounts is deducted from later payouts.
Each commission becomes payable one month after we receive the payment it comes from. We pay payable commissions monthly, within 30 days after the end of the month, by PayPal, Stripe or bank transfer to the details you give us. Balances under US$50 roll over to the next month, because bank and transfer fees would take too large a share of a small payment. You are responsible for your own taxes and may need to give us tax forms (for example W-9 or W-8BEN) before we pay.
Your affiliate page shows the businesses you referred (business name, sign-up date, plan and status), your commissions and your payouts. You sign in with a link we e-mail to the address you applied with.

4. How you may promote AI Build

Disclose the relationship. Wherever you recommend AI Build, clearly say that you earn a commission (for example "I earn a commission if you sign up through my link"), close to the recommendation and easy to notice, as required by the U.S. Federal Trade Commission's Endorsement Guides and similar laws.
Describe AI Build truthfully and use only the features and prices on our website. Do not promise results, discounts or terms we do not offer.
Do not send spam or unsolicited messages or calls, buy ads on our brand names or confusingly similar terms, use our name in domain names or social accounts, pose as us, write fake reviews, or use cookie stuffing or other ways to get credit for visitors you did not refer.
Follow all laws that apply to your marketing, including anti-spam, privacy and consumer protection laws. You may use our name and logo only as we provide them and only to promote AI Build.

5. Ending the program

You may leave the program at any time by e-mail. We may end your participation, or the program, with 30 days' notice, or immediately for a breach of these Affiliate Terms. When participation ends, commissions already earned on payments received until then are paid, unless it ended because of fraud or a serious breach; no commission is earned afterwards.

6. Changes

We may change these Affiliate Terms, including the commission rate for future payments, with at least 30 days' notice by e-mail. If you do not agree, you may leave the program before the change takes effect.
